About These Terms
These Terms of Use govern access to and use of the PitPeds website, pedigree database, membership services, and related features.
By accessing or using PitPeds, creating an account, purchasing a membership, submitting information, or using any PitPeds service, you agree to these Terms of Use.
If you do not agree to these terms, you should not use PitPeds.
Purpose of PitPeds
PitPeds is an American Pit Bull Terrier pedigree research platform dedicated to preserving pedigrees, bloodlines, historical records, photographs, and information related to the American Pit Bull Terrier.
PitPeds provides tools that allow users to research pedigree information, view dog records, submit information, suggest corrections, and use other features made available through the platform.
Pedigree Information and Accuracy
PitPeds is committed to maintaining an accurate and reliable pedigree database. However, pedigree and historical information may originate from many sources, including users, breeders, owners, registries, historical records, registration documents, publications, photographs, and other available documentation.
PitPeds does not guarantee that every pedigree record, historical statement, registration detail, ownership record, photograph, or other piece of information contained in the database is complete or error-free.
Users who believe information is inaccurate are encouraged to submit a correction and, when available, supporting documentation. Corrections and submitted information may be reviewed by a PitPeds administrator before changes become part of the public database.
User Accounts
Certain PitPeds features may require a user account. You are responsible for providing accurate account information and for keeping your login credentials secure.
You are responsible for activity that occurs through your account. You should notify PitPeds if you believe your account has been accessed or used without authorization.
PitPeds may restrict, suspend, or terminate an account when reasonably necessary to protect the platform, its users, or the integrity of the pedigree database, including in cases involving fraud, abuse, intentional submission of false information, unauthorized access, or violations of these Terms.
Memberships and Payments
Some PitPeds features require a paid membership. Membership prices, billing periods, and included features are displayed on the applicable membership or checkout page.
Membership payments are processed through PayPal. By purchasing a membership, you also agree to any applicable PayPal terms governing your payment transaction or subscription.
Recurring memberships continue according to the selected billing period until canceled. Cancellation stops future renewal charges but does not automatically refund amounts already paid.
Unless otherwise required by applicable law, membership fees already paid are non-refundable.
Membership Access
Access to membership features is provided only while the applicable membership is active.
Memberships are associated with the individual account through which they were purchased and may not be transferred, shared, resold, or used to provide unauthorized access to paid PitPeds features.
PitPeds may change, improve, add, or remove platform features over time as the service develops. Reasonable efforts will be made to avoid unnecessarily disrupting active membership services.
User Submissions
Users may be permitted to submit dog information, pedigree information, photographs, historical information, corrections, supporting documents, and other materials to PitPeds.
You are responsible for the accuracy of information you submit and should not knowingly submit false, misleading, fraudulent, or fabricated information.
Submission of information does not guarantee that it will be added to or remain in the public database. PitPeds may review, verify, approve, reject, correct, organize, or remove submitted information when reasonably necessary to maintain the quality and integrity of the database.
Supporting Documentation
PitPeds may request or accept supporting documentation to help verify pedigree records, registration information, ownership information, historical claims, or suggested corrections.
Submitting documentation does not necessarily mean the original document will be displayed publicly. PitPeds may use documentation for verification while displaying only the information relevant to the pedigree record.
Users should not submit documents containing unnecessary sensitive personal information.
Photos and Other Submitted Content
By submitting photographs, documents, written information, or other content to PitPeds, you represent that you have the right or appropriate permission to submit that material for the purposes for which it is provided.
You retain any ownership rights you may have in content you submit. However, by submitting content for inclusion in the PitPeds database or website, you grant PitPeds a non-exclusive, worldwide, royalty-free license to store, reproduce, display, format, resize, organize, and use that content as reasonably necessary to operate, preserve, maintain, and display the PitPeds pedigree database and related services.
This permission continues for content incorporated into historical pedigree records unless removal is required by applicable law or PitPeds determines that removal is appropriate.
Acceptable Use
You may use PitPeds for lawful pedigree research, historical research, personal reference, and other purposes consistent with the operation of the platform.
You may not use PitPeds to:
- Attempt to gain unauthorized access to accounts, administrative systems, or restricted areas of the platform
- Circumvent membership restrictions or other access controls
- Scrape, harvest, copy, or systematically extract substantial portions of the PitPeds database without permission
- Use automated systems, bots, scripts, or similar methods to collect PitPeds data without authorization
- Knowingly submit false, fraudulent, misleading, or malicious information
- Upload malicious files, software, or code
- Interfere with the security, availability, or normal operation of PitPeds
- Use PitPeds in violation of applicable law
Database and Website Content
The organization, presentation, design, software, original written content, graphics, branding, and compilation of the PitPeds website and database are protected by applicable intellectual property laws.
Individual historical facts and pedigree facts may originate from public, historical, registry, user-submitted, or other sources. These Terms do not claim ownership over facts that are not legally subject to ownership.
However, unauthorized copying, reproduction, redistribution, scraping, republishing, or commercial exploitation of the PitPeds database or substantial portions of its organized content is prohibited to the extent permitted by law.
Third-Party Information and Services
PitPeds may contain information originating from or referring to third parties, including registries, breeders, owners, kennels, historical sources, payment providers, and other services.
Reference to a third party does not necessarily constitute endorsement, sponsorship, affiliation, or approval by that third party.
Third-party websites and services are governed by their own terms and policies. PitPeds is not responsible for the availability, content, security, or practices of third-party services that it does not control.
Disclaimer of Warranties
PitPeds is provided for pedigree research, historical preservation, and informational purposes.
The platform and its content are provided on an “as is” and “as available” basis. To the extent permitted by applicable law, PitPeds makes no warranties, express or implied, regarding the completeness, accuracy, reliability, availability, or suitability of the website, database, pedigree records, historical information, or other content.
Pedigree Analysis and Estimated Contributions
Any pedigree analysis, ancestor influence, estimated contribution, concentration, or similar calculation provided by PitPeds is based on pedigree positions and available pedigree records.
These calculations are estimates for pedigree research purposes. They are not DNA tests, genetic testing results, veterinary evaluations, or guarantees of an individual dog’s genetic makeup, traits, health, performance, or breeding outcome.
No Veterinary, Breeding, or Professional Advice
Information provided through PitPeds is for pedigree research and historical reference and should not be considered veterinary, medical, genetic, breeding, legal, or other professional advice.
Users are responsible for making their own decisions and obtaining appropriate professional advice when necessary.
Limitation of Liability
To the extent permitted by applicable law, PitPeds and its owner, administrators, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of, inability to use, or reliance upon PitPeds or information contained in the platform.
PitPeds is not responsible for losses or disputes resulting from inaccurate, incomplete, outdated, disputed, or user-submitted pedigree information.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Account Suspension or Termination
PitPeds may suspend, restrict, or terminate access to an account when reasonably necessary to protect the platform, its users, the pedigree database, or the integrity of PitPeds services.
Termination of an account does not necessarily require removal of accurate historical pedigree information or other records that have been incorporated into the PitPeds database.
Changes to These Terms
PitPeds may update these Terms of Use as the platform, its services, membership features, or applicable requirements change.
Updated Terms will be posted on this page with a revised effective date. Continued use of PitPeds after revised Terms become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms of Use are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
